Spain v the Unitary Patent – CJEU gives Unanimous Points Decision to the Unitary Patent System
Unless you’ve missed it somehow, INTA is on and the average patent attorney is probably feeling a little left out as emails and photos of the latest INTA party do the rounds. Well fear not patent attorney brethren because the unitary patent system has a lot going on today.
Yes, on a day that literally no-one (but me) is calling Turbo Tuesday, we can look forward to the CJEU’s judgments in C-146/13 and C-147/13 (Spain v the Unitary Patent: the rematch) and a packed Preparatory Committee meeting in which we expect the details surrounding the European Patent Litigators Certificate to be finalised and the consultation on the court fees for the Unified Patent Court to be given the go ahead.
The Spanish result is first up and while the judgments weren’t available at the time of writing available, a press release has been, well, released which dismisses both of Spain’s actions. [Update: the judgments are now available – C-146/13 and C-147/13] (more…)

UPC Update: UK Purdah and a Belgian challenge
The UK election is on its way (in case you hadn’t noticed) and while Dave, Ed, Nick and Nigel battle it out, UK government civil servants are now in the period of purdah. During purdah, which is the period between the calling of a General Election and the General Election, rules apply which limit what can be said and done in public by civil servants to ensure they are impartial during the election process. As a result the UK UPC Taskforce is likely to be fairly quiet until after 7 May 2015.
Before they went into this period of restricted communication however, the UK UPC Taskforce issued another UPC update, the main points of which are noted below. Also highlighted below is a challenge against the ratification of the UPC Agreement in Belgium (Note: Belgium ratified the UPC agreement on 6 June 2014). (more…)
The UPC and Patent Litigation at the High Court and the IPEC
Published recently on the UKIPO website is a report examining the number of patent cases at both the UK High Court and the Intellectual Property Enterprise Court in the period 2007-2013.
The High Court and IPEC of course both currently have jurisdictions over matters relating to UK patents granted by the UKIPO and EP patents validated in the UK. The introduction of the Unified Patent Court may impact the number of EP(UK) patents that are handled by these two venues and the UKIPO report attempts to quantify the number of cases that have been filed at the High Court and IPEC. International Women’s Leadership Forum – Forum Report
Managing IP’s International Women’s Leadership Forum was held in London recently and proved to be a very worthwhile day for both inhouse counsel and private practice attendees.
Emma Barraclough, Group Editor of Managing IP kindly invited me to attend and to prepare a series of short follow up articles for the IPcopy blog. These will be posted on IPcopy over the next few weeks. Emma is one of the driving forces behind the development of the Women in IP network and the London forum follows on from successful events she hosted in New York and San Jose last year. The UPC in London: a look at the location options
The long road to the UPC
In the last week or so discussion around the potential location of the UPC in London has surfaced again with news that the UPC Taskforce has informally approached a number of groups including IPLA, IP Federation, EPLAW and others for their views of a couple of potential sites for London’s UPC divisions. Full details of the two sites in question can be found here.
After reading the IPKat articles (1, 2) on the subject, IPcopy reached out to the UPC Taskforce and others to try and glean some additional information on the issue. This is presented below along with, for what it’s worth, this ipcopywriter’s personal views on the issue. (more…)

The Unitary Patent Package: Two years on. Where are we now? (Overview of the Court)
Back in December 2012 it was announced, in an historic agreement, that the European Parliament had adopted two regulations relating to the creation of the unitary patent. A third element of the unitary patent package, the agreement on the unified patent court, was signed in February 2013 and the EPO expected the first unitary patent to roll off the production line in Spring 2014. It’s now nearly the end of 2014 and we’ve not met the original, highly ambitious implementation date but there has been significant progress in delivering the new system.
Starting this week IPcopy is taking a look (in traditional IPcopy Q&A styleTM) at what the unitary patent package is and where we are. Unbelievably we’ve never really covered the actual structure of the new Unified Patent Court and so here, as your starter for 10, is an overview of the UPC itself. (more…)
