Unitary Patent: News Nuggets (ERA Conference – December 2014)
On 4th and 5th December IPcopy attended the ERA conference “Preparing for the Unitary Patent Package” at the Old Hall in Lincoln’s Inn*.
The latest progress and developments relating to the implementation of the Unitary Patent Package (UPP) were on the menu and the conference included a distinguished group of speakers, many of whom are involved directly in the implementation process. We’ll try and post some more in depth comment in the next week or so on a couple of the talks/subjects discussed but in the meantime here’s some nuggets of news…. (more…)
Unitary Patent and the UPC: a talk by Neil Feinson at the Westminster Legal Policy Forum
I was fortunate enough to attend last week’s seminar of the Westminster Legal Policy Forum in London. An overview of the seminar will appear on IPcopy later. This post will instead focus on one of the keynote addresses given by Neil Feinson, Director of International Policy, IPO and UK Representative, UPC Preparatory Committee.

Unitary patent and Unified patent court – Conference Review (Part II)
As noted yesterday, I attended the 2nd annual conference on the “Unitary patent and Unified patent court” held in Paris on 4 July. The report of the early morning sessions ((1) and (2)) from this conference can be found in yesterday’s post. Denmark ratifies the Unified Patent Court Agreement
Following recent posts about Sweden and Belgium depositing their instruments of ratification in Brussels (Bork! and Belgium), we understand* that Denmark has now also deposited its instrument of ratification. This information is available on the Council of the European Union website here. This news brings the total official number of countries in the unitary patent system to five (after Austria, France, Sweden and Belgium).
Denmark is expected to host a local division of the UPC in Copenhagen, with Danish and English being the languages of the proceedings.

And now Belgium ratify the UPC Agreement!
Following yesterday’s post about Sweden depositing its instrument of ratification in Brussels (Bork!), we were notified by reader Hans van de Heuvel that Belgium has now also deposited their instrument of ratification. This information is available on the Council of the European Union website here. This news brings the total official number of countries in the unitary patent system to four (after Austria, France and Sweden).
Next up on the list could be Denmark as this site appears to suggest they have now got Royal Assent for their UPC Act following their recent referendum.

Bork! Sweden ratifies UPC Agreement

Update
According to the European Commission website, Sweden deposited its instrument of ratification on 5 June 2014 to become the third country to complete its ratification formalities. Sweden are involved in setting up a Nordic-Baltic regional division of the Unified Patent Court and join France and Austria as the three countries who have completed the ratification process. Belgium and Malta have ratified the agreement but not yet deposited their instruments of ratification.

Unitary patent: Danish Referendum – “Yes” vote
Yesterday, 25th May 2014, Denmark held a referendum on joining the Unified Patent Court. Out of just over 2.3 million votes cast, 62.5% voted in favour of joining the Unified Patent Court. The Danish parliament is now free to complete ratification of the Unified Patent Court Agreement and, eventually, deposit its instrument of ratification with the EU Commission. Currently only Austria and France have made such a deposit.

IP Bill becomes the Intellectual Property Act 2014

The Intellectual Property Bill left the “ping pong” stage last month after the House of Lords approved the amendments made to the Bill by the House of Commons. Yesterday evening, the IP Bill received Royal Assent to pass into law as the Intellectual Property Act 2014 (House of Lords Hansard; Parliament (Intellectual Property Act 2014)).
As noted on the Department for Business Innovation and Skills website it is expected that some measures within the Act will come into force in October 2014, with all the measures being implemented by late 2015. (more…)
