Are the UPC rules on opt out flawed?
With the UPC sunrise period due to start on 1 January 2023, the patent profession is anticipating filing many advance opt out requests in respect of their clients’ existing EP patents.
However, is there a flaw in the opt out rules that means some EP patents will require a lot more work before they can be opted out or even make it impossible to opt some patents out? (more…)
Revised Rules of Procedure of the Boards of Appeal
On 1 January 2020 the new Rules of Procedure of the Boards of Appeal (“RPBA”) came into force, affecting substantially all(1) appeals pending on, or filed after 1 January 2020. The revised rules have three main aims: i) to increase the efficiency of the appeals procedure; ii) to improve predictability for parties; and iii) to harmonise the approach of the Boards (particularly in regard to the admissibility of amendments to a party’s case). UPC Update – Rules of Procedure
At the last meeting of the Preparatory Committee, the 18th draft of the Rules of Procedure of the Unified Patent Court was adopted.
This 18th draft will, subject to some modifications when the court fees have been decided, form the final version of the Rules of Procedure.
The 18th draft does not comprise too many substantive changes from the previous version (a handy comparison of the two versions can be seen here) but IPcopy notes the following changes: (more…)

Opt out fee
The regulations and agreements surrounding the unitary patent package have been picked over many times which has resulted in discussions about “hard coded bifurcation“, the Malta problem and just what the “exclusive competence” of the UPC means. To add to that list we now have the question: “Just what is the legal basis for the opt out fee?” (more…)
The Unitary Patent Package: Two years on. What progress has been made?
Back in December last year IPcopy started to take a look back at the unitary patent package and where we are in delivering this new unitary patent system. Our first “Where are we now?” post provided an overview of the Unified Patent Court itself. This entry asks what progress has there been on the road to getting the system up and running. Remember that although the original implementation date (end of 2014) was missed there has been some significant progress in delivering the new system. (more…)
