Unified patent courtThe Preparatory Committee’s Unified Patent Court website has been updated today with details of the latest version of the Rules of Procedure (17th Draft) and the Oral Hearing to discuss those rules.

The 17th Draft of the Rules of Procedure can be found here in Tracked Changes version. Additions in red have come via the public consultation. Additions in blue are from the Legal Group.

IPcopy will be picking through the changes in due course but notes in the meantime that Rule 40 has been amended to try and reduce the possible side effects of a bifurcated case. Under amended Rule 40 the central division will endeavour to hear the revocation part of the case before the infringement part of the case is heard in the local/regional division.

The oral hearing to discuss the latest draft will be held on 26 November 2014 between 9am and 6pm at the European Law Academy (ERA) in Trier. This is an invite only event but a webcast of the event is planned which should be accessible via the  European Law Academy website www.era.int.
