European Patent Litigation Certificate – responses to consultation
Before the summer recess the Unified Patent Court Preparatory Committee ran a consultation on the European Patent Litigation Certificate (EPLC). Regular readers will recall that this certificate links to Article 48 of the UPC Agreement which states that parties may either be represented by lawyers authorised to practice before a court of a Contracting Member State or by European Patent Attorneys who have “appropriate qualifications such as a European Patent Litigation Certificate”.
The consultation closed on 25 July and, according to the latest Preparatory Committee roadmap, a revised version of the EPLC rules is expected early 2015. In the meantime one of our Twitter followers (thank you Guillaume S./@EPpatent) kindly pointed us at the Bristows UPC website where a few of the responses to the EPLC consultation are hosted.
Given that these responses include representatives from patent attorneys and also from lawyers we thought it might be fun to see how far apart the responses were! (more…)
Implementing the Unitary Patent provisions in the UK – the unclear scope of the software directive on UK patent infringement
The UK recently held a consultation relating to the implementation of the Unified Patent Court Agreement and the two unitary patent regulations into UK law. One of the suggested changes was the addition of some new defences to patent infringement in section 60(5) of the Patents Act. (more…)

Unitary patent – Preparatory Committee Updates
The Preparatory Committee for the Unified Patent Court has updated their website to indicate that a number of experts have been invited to join an Expert Panel to provide informal advice to the various work streams that exist in the UPC roadmap. The UPC website has also been updated with a new roadmap.
An introduction to the Unitary Patent

EPO – Rules relating to Unitary Patent Protection
The EPO Select Committee approved the Rules relating to unitary patent protection on 24 June. A copy of these rules has appeared online and is discussed below.
During a session of the recent “Unitary patent and Unified patent court” seminar held in Paris, Jerome Debrulle (Chair EPO Select Committee) indicated that the Select Committee had approved the rules that will be used to administer the unitary patent. IPcopy had not seen a copy of these rules at the time of our conference review post but now, thanks to reader Hans van Tongeren, we have been pointed towards what appears to be the latest version of the rules, which can be found on the Bristows website here.
The EPO’s rules document runs to over 80 pages and there is also a 40+ page Annex which highlights the changes from the previous version of the rules. An overview of the structure of the rules document is provided below along with some “highlights” from the rules themselves.
Unitary patent and Unified patent court – Conference Review (Part II)
As noted yesterday, I attended the 2nd annual conference on the “Unitary patent and Unified patent court” held in Paris on 4 July. Denmark ratifies the Unified Patent Court Agreement
Following recent posts about Sweden and Belgium depositing their instruments of ratification in Brussels (Bork! and Belgium), we understand* that Denmark has now also deposited its instrument of ratification. This information is available on the Council of the European Union website here. This news brings the total official number of countries in the unitary patent system to five (after Austria, France, Sweden and Belgium).
Denmark is expected to host a local division of the UPC in Copenhagen, with Danish and English being the languages of the proceedings.

European Patent Litigation Certificate – CIPA’s Public Consultation Seminar
Article 48(2) of the Agreement on the Unified Patent Court (which relates to representation) states: “Parties may alternatively be represented by European Patent Attorneys who are entitled to act as professional representatives before the European Patent Office pursuant to Article 134 of the EPC and who have appropriate qualifications such as a European Patent Litigation Certificate“.
What constitutes a European Patent Litigation Certificate has been the subject of much discussion already (here’s an earlier IPcopy article) and is now the subject of a formal consultation (details here) with a closing date of 25 July.
